AGREEMENT TO OUR LEGAL TERMS

We are WANDERCHIC TRAVEL, doing business as Chic Trip ("Company," "we," "us," "our"), a company registered in France at 50 avenue des Champs-Élysées, Paris, Île-de-France 75008. Our VAT number is FR34999119472.

These Terms of Sale ("Agreement") govern the purchase of "The Foundations" travel planning service from Chic Trip. By completing your purchase, you ("Client" or "you") agree to these terms.

IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM PURCHASING THE SERVICES AND YOU MUST NOT PROCEED WITH PAYMENT.

Professional Liability Insurance & Financial Guarantee

We will provide prior notice of any changes to these terms by email at contact@chic-trip.com. By continuing to use the Services after changes become effective, you agree to be bound by the modified terms.

Professional Liability Insurance & Financial Guarantee

Chic Trip maintains professional liability insurance ("RC Pro") with Hiscox Assurances, policy n° HSXIN320079059A, valid from 27/02/2026 (annually renewable by tacit reconduction), covering travel consulting and coordination activities up to 1 500 000 € per claim.

1. SERVICE DESCRIPTION & RELATIONSHIP

Chic Trip acts as a digital consultancy and does not operate as a traditional travel agency for The Foundations package. We provide pre-designed, non-personalized digital travel itineraries exclusively.

1.1 What The Foundations Includes

Upon payment, Chic Trip shall provide the following digital services:

·       Instant Digital Itinerary: A day-by-day Paris schedule pre-designed based on your selected duration (strictly non-personalized)

·       Interactive Mobile Access: Access to the Chic Trip proprietary app containing maps, logistics information, and travel guides

·       Direct Booking Links: Curated recommendations for hotels and restaurants with direct booking links

·       Downloadable Resources: Digital files in accessible formats for your personal use

1.2 Do-It-Yourself (DIY) Nature

The Foundations is a Do-It-Yourself planning tool. You are entirely responsible for:

·       Making and managing all reservations (flights, hotels, restaurants, activities)

·       Verifying availability at the time of your booking

·       Paying all vendors and service providers directly

·       Consulting and adhering to each vendor's terms and cancellation policies

Chic Trip does NOT reserve anything for you and does NOT intervene directly with service providers.

1.3 Services NOT Included

The following services are not included in The Foundations and are not available at this package level:

·       Real-time customer support or WhatsApp assistance

·       Disruption management (rebooking in case of cancellations or changes)

·       Availability guarantees for recommended restaurants or hotels

·       Coordination with third-party vendors

·       Travel insurance or emergency coverage

·       Concierge services of any kind

2. FINANCIAL TERMS & PAYMENT

2.1 Pricing

·       Standard Price: $637.00 USD (one-time service fee, all-inclusive)

·       Launch Promotional Price: $446.00 USD (one-time service fee, subject to availability)

All prices are final and include all applicable fees.

2.2 Zero Markup Guarantee

Chic Trip guarantees a zero markup policy. We do not add commissions or markups to the prices of recommended hotels, restaurants, or activities. All pricing shown through Chic Trip links reflects standard public rates offered directly by vendors.

You remain responsible for comparing prices across different booking platforms and negotiating directly with service providers.

2.3 Payment Processing

·       Payment Method: Credit card via Stripe (Visa, Mastercard, American Express accepted)

·       Currency: USD

·       Timing: Payment required at point of purchase

·       Processing: Service delivery within instantly after payment confirmation

2.4 Foreign Transaction Fees

You are solely responsible for any foreign transaction fees charged by your banking institution. Chic Trip is not responsible for bank charges, currency conversion fees, or international payment processing charges.

3. SERVICE DELIVERY & ACCESS

3.1 Delivery Timeline

After payment is confirmed:

·       Itinerary PDF: Delivered via email within instantly

·       App Access: Activated immediately upon account setup

·       Duration: 12-month access period from delivery date

3.2 Digital Itinerary

You will receive a professional PDF document containing:

·       Detailed day-by-day itinerary for your European trip

·       Recommendations for accommodation, dining, and activities

·       Practical logistics and transportation information

·       Direct links to booking platforms

This document is yours to keep and reference throughout your planning process.

3.3 Application Access Terms

·       Personal Use Only: App access is strictly for your individual travel planning use

·       Single User Account: One account per purchase

·       Device Synchronization: You may access the app across multiple personal devices

·       Duration: 12-month access from activation date

·       Extension: Access renewal available for additional fee upon request

4. CLIENT RESPONSIBILITIES & ACKNOWLEDGMENTS

4.1 Your Responsibilities

You acknowledge and accept that:

·       You are solely responsible for all booking decisions and reservations

·       You will verify availability, pricing, and terms directly with each service provider

·       You will review and accept each vendor's specific cancellation, refund, and modification policies

·       You will arrange appropriate travel insurance covering all trip contingencies

·       You will verify visa, passport, and entry requirements for France

·       You will maintain copies of all confirmations and receipts

·       You will respect local laws and customs during your travel

4.2 No Availability Guarantees

Chic Trip cannot guarantee that:

·       Recommended restaurants will have availability on your desired dates

·       Recommended hotels will have rooms available at recommended rates

·       Prices shown at time of itinerary delivery will remain unchanged at time of booking

·       Any restaurant or hotel will not be temporarily or permanently closed

·       Attractions or museums will be open on your visit dates

All recommendations are provided at the time of itinerary delivery and are subject to real-time availability changes.

4.3 Timing Recommendations

To maximize your chances of securing recommended establishments, we recommend:

·       Booking accommodations 2-3 months in advance

·       Reserving restaurants 1-2 months ahead

·       Verifying opening hours and special closures before visiting

·       Comparing prices across multiple platforms (Booking.com, TripAdvisor, official hotel websites, etc.)

5. INTELLECTUAL PROPERTY & USAGE RIGHTS

5.1 Our Content Ownership

All content provided in The Foundations—including the itinerary, curated lists, recommendations, maps, guides, photography, descriptions, and proprietary travel expertise—is the exclusive intellectual property of Chic Trip and protected under international copyright laws.

5.2 Your License Grant

You receive a limited, personal, non-transferable, non-exclusive license to:

·       Access and view your itinerary for personal trip planning purposes

·       Download and store one personal copy on your device

·       Use the information to make reservations directly with service providers

·       Share your itinerary with immediate travel companions for the same trip

5.3 Strict Prohibitions

You explicitly agree NOT to:

·       Reproduce, copy, or duplicate the itinerary (in whole or part)

·       Share, distribute, resell, or republish the content to other individuals or groups

·       Post the itinerary or content on social media, blogs, forums, or websites

·       Use the content for commercial purposes or competitive analysis

·       Create derivative works or modified versions of the itinerary

·       Provide the content to travel agencies, booking platforms, or competitors

·       Share access to the Chic Trip app with other users or accounts

·       Reverse engineer or attempt to extract Chic Trip's proprietary planning methodology

5.4 Consequences of Violation

Unauthorized use or distribution of The Foundations content will result in:

·       Immediate suspension of your app access

·       Legal action to enforce intellectual property rights

·       Potential damages and injunctive relief

·       Reporting to relevant platforms for copyright violation

6. NO-REFUND & CANCELLATION POLICY

6.1 Final Sale Policy

All sales of The Foundations are final and non-refundable immediately upon purchase as digital access is instantly granted.

Due to the nature of digital products, we do not offer refunds for:

·       Change of mind or buyer's remorse

·       Trip cancellations or postponements by you

·       Dissatisfaction with recommendations or content quality

·       Inability to book recommended establishments

·       Changes in travel dates, companions, or budget

·       Personal circumstances or life changes

6.2 Renunciation of Legal Right of Withdrawal

In accordance with Article L. 121-21-8 of the French Consumer Code (Code de la consommation), you expressly renounce your legal right to withdraw from this purchase. This exemption applies because:

·       The digital content is immediately unlocked and fully executed upon payment

·       You have explicitly requested immediate service execution

·       You have accepted the terms before delivery

6.3 Exceptional Circumstances

A partial refund (50% maximum) may be considered only in the following circumstances:

·       Demonstrable Technical Failure: A critical technical error on Chic Trip's part that completely prevents access to your itinerary (not recoverable through standard troubleshooting)

·       Complete Service Unavailability: The app remains inaccessible for more than 5 business days after you have made reasonable attempts to resolve the issue with our support team

Any refund decision is made entirely at Chic Trip's discretion and must be requested in writing within 7 days of purchase.

6.4 Technical Support Process

In case of technical issues, you must:

·       Contact support@chictrip.com with screenshots and detailed description

·       Allow 5 business days for Chic Trip to investigate

·       Follow recommended troubleshooting steps (browser clearing, app reinstall, etc.)

·       Accept technical solutions offered (app reinstall, password reset, account recreation, etc.)

7. LIMITATION OF LIABILITY

7.1 Scope of Limitation

Chic Trip provides recommendations based on local expertise and market research. However, Chic Trip shall NOT be held liable for:

·       Any disputes, dissatisfaction, or conflicts with third-party vendors (hotels, restaurants, transportation companies)

·       Quality, cleanliness, service standards, or ambiance of recommended establishments

·       Delays, cancellations, or modifications of flights, trains, or other transportation

·       Unexpected closures of museums, monuments, or attractions

·       Changes in operating hours or seasonal closures

·       Physical injuries, accidents, or loss of property during your trip

·       Incompatibility between recommendations and your personal preferences

·       Errors or omissions in information provided (despite reasonable diligence)

·       Performance of third-party vendors or service providers

·       Force majeure events (pandemics, natural disasters, civil unrest, etc.)

7.2 Your Sole Responsibility

You acknowledge you are solely responsible for:

·       Your booking decisions and vendor selection

·       Your physical and medical fitness to travel

·       Your travel insurance coverage

·       Your compliance with visa and entry requirements

·       Your personal conduct and behavior during travel

·       Your interactions with vendors and other travelers

·       Financial and legal consequences of your actions

7.3 Liability Cap

In no event shall Chic Trip's total liability exceed the amount you paid for The Foundations ($637.00 USD or $446.00 USD as applicable).

Chic Trip shall NOT be liable for indirect, incidental, consequential, special, or punitive damages, including but not limited to:

·       Lost revenue or travel expenses

·       Loss of opportunities or missed experiences

·       Emotional distress or reputational harm

·       Costs related to trip modifications or cancellations

·       Third-party claims or vendor disputes

8. TRAVEL INSURANCE & RISK ACKNOWLEDGMENT

8.1 Chic Trip Does NOT Provide Insurance

Chic Trip provides no travel insurance, medical coverage, or risk protection whatsoever. You acknowledge that:

·       Chic Trip cannot cover medical expenses or emergencies

·       Chic Trip cannot cover trip cancellations or interruptions

·       Chic Trip cannot cover baggage loss, theft, or damage

·       Chic Trip cannot cover vendor cancellations or service failures

·       You are entirely responsible for obtaining adequate coverage

8.2 Your Insurance Obligation

You agree to purchase comprehensive travel insurance that covers:

·       Trip cancellation and interruption

·       Medical and emergency evacuation

·       Personal liability and property damage

·       Baggage loss and delay

·       Travel delay and missed connections

·       Any other risks relevant to your personal circumstances

8.3 Vendor Risk Allocation

In case of any incident or accident during your trip:

·       Primary Responsibility: The service provider directly involved (hotel, restaurant, tour operator)

·       Secondary Responsibility: Your personal travel insurance policy

·       Chic Trip's Responsibility: NONE - Chic Trip is not party to any transaction or incident

9. PROHIBITED ACTIVITIES

You agree NOT to:

·       Share, resell, or license The Foundations itinerary or content to others

·       Use The Foundations content for commercial purposes or competitive analysis

·       Create derivative works based on Chic Trip's proprietary methodology

·       Attempt to reverse engineer or decompile any Chic Trip technology

·       Share access credentials to the Chic Trip app with unauthorized users

·       Make unauthorized copies of the itinerary or recommendations

·       Post The Foundations content on social media or public platforms

·       Use The Foundations to create competing travel planning services

·       Violate any applicable laws or regulations in using the Services

·       Engage in any activity that harms Chic Trip's business or reputation

Violation of these terms will result in immediate access termination and potential legal action.

10. DATA PROTECTION & PRIVACY (GDPR)

10.1 Personal Data Collection

Chic Trip collects and processes the following personal data:

·       Name, email address, phone number

·       Purchase information (selected travel duration)

·       Payment information (processed via Stripe; NOT stored by Chic Trip)

·       App usage data and technical logs

·       Communication records

10.2 Legal Basis for Processing

Your data is processed for:

·       Contract Performance: Providing The Foundations and app access

·       Explicit Consent: Marketing communications and service improvements

·       Legal Compliance: Tax, accounting, and regulatory obligations

·       Legitimate Interest: Service improvement and fraud prevention

10.3 Data Retention

Personal data will be retained for:

·       During Service Period: Full 12-month app access duration

·       After Expiration: 3 years for tax and legal compliance

·       App Logs: Automatically deleted after 12 months of inactivity

·       Marketing Communications: Until you unsubscribe

10.4 Data Sharing

Your data will NOT be sold or shared with third parties except:

·       Payment Processing: Stripe (PCI-compliant payment processor)

·       Cloud Infrastructure: Supabase (database provider with EU data centers)

·       Legal Compliance: Tax authorities and law enforcement (if required)

·       Dispute Resolution: Legal counsel or courts (if litigation occurs)

All third-party providers have signed Data Processing Agreements (DPA) complying with GDPR Article 28.

10.5 Your GDPR Rights

You have the right to:

·       Access: Obtain a copy of your personal data

·       Rectification: Correct inaccurate information

·       Erasure: Request deletion of your data

·       Portability: Receive your data in standard format

·       Objection: Refuse marketing communications

10.6 Data Protection Authority

If you believe Chic Trip violates GDPR, you may file a complaint with:

11. MODIFICATIONS & SERVICE CHANGES

Chic Trip reserves the right to:

·       Modify or discontinue The Foundations package with 30 days' notice

·       Update the app interface and features at any time

·       Change pricing for future purchases

·       Temporarily suspend services for maintenance

·       Refuse service to users who violate these terms

Your continued use of services after notification constitutes acceptance of modifications.

12. GOVERNING LAW & JURISDICTION

12.1 Applicable Law

These Terms are governed by French law and the laws of the European Union, independent of your location.

12.2 Jurisdiction

·       For French/EU Residents: You agree to submit to the exclusive jurisdiction of the courts of Paris, France

·       For International Clients: You agree to submit to the jurisdiction of Paris courts for dispute resolution

·       Consumer Protection: EU consumers retain rights under their country of residence's consumer protection laws

12.3 Language

These Terms are provided in English. Any translation is for convenience only; English version controls.

13. DISPUTE RESOLUTION

13.1 Informal Resolution (30 Days)

Before initiating any formal proceedings, the parties agree to attempt resolution through good-faith negotiation for at least 30 days.

13.2 Mediation

If informal negotiation fails, parties agree to submit to non-binding mediation with a mutually agreed mediator before pursuing litigation.

13.3 Arbitration

Any dispute not resolved through mediation shall be submitted to binding arbitration administered by the European Centre of Arbitration (Strasbourg), with:

·       Seat of Arbitration: Paris, France

·       Language: English

·       Applicable Law: French law

·       Arbitration Rules: European Court of Arbitration Rules in force at time of filing

13.4 Class Action Waiver

You agree that any arbitration shall be limited to disputes between you and Chic Trip individually. Class action proceedings are not permitted.

15. FINAL PROVISIONS

15.1 Entire Agreement

These Terms constitute the complete agreement between you and Chic Trip regarding The Foundations. Any prior discussions, representations, or agreements are superseded by these Terms.

15.2 Amendment

Chic Trip may modify these Terms at any time. Modifications are effective upon email notification. Your continued use of services after notification indicates acceptance.

15.3 Severability

If any provision is found unenforceable, that provision is severed while all other provisions remain in full effect.

15.4 No Waiver

Failure to enforce any right under these Terms does not constitute a waiver of that right.

15.5 Non-Agency Relationship

No partnership, joint venture, employment, or agency relationship exists between you and Chic Trip.

15.6 Electronic Communications

You consent to receive all legal notices, disclosures, and communications via email. Electronic communications satisfy all written notice requirements.

16. ITINERARY ACCESS DURATION

The digital itinerary (or itineraries) provided as part of this package shall remain accessible to the Client via the Chic Trip platform (chic-trip.com) for a period of eighteen (18) months from the date of payment confirmation.

After this 18-month period, access to the itinerary may be deactivated without prior notice. The Client is encouraged to download or export their itinerary in PDF format before the expiration of this access period.

This access duration applies to the digital consultation of the itinerary only and does not affect any PDF documents previously downloaded by the Client.

17. ACKNOWLEDGMENT & ACCEPTANCE

BY COMPLETING YOUR PURCHASE, YOU ACKNOWLEDGE:

·       You have read and fully understand these Terms

·       You accept the DIY nature of The Foundations

·       You understand refunds are not available

·       You assume all responsibility for your travel planning and bookings

·       You will obtain adequate travel insurance

·       Chic Trip is not liable for vendor performance or travel incidents

·       You accept all limitations of liability stated herein

Your purchase constitutes legal acceptance of all terms stated above.

These Terms of Sale apply to all purchases of The Foundations package made via chic-trip.com or direct sales channels from this date forward.
